The two positions of the CNM in evaluation of Judge Moisés Ferrer

The judge of the Third Room of the Supreme Court of Justice Moisés Ferrer Landrónone of the three judges of that high court not confirmed by the National Council of the Judiciary (CNM), also failed to overcome the assessment by the qualified vote of the president Luis Abinader.

As happened with Judge Pilar Jiménez, the votes for and against Ferrer Landrón concluded in a draw and the president’s vote disfavored him. Below are published in full the two positions of the CNM.

First position:

“In relation to the magistrate Moisés Ferrer Landrón Some elements were also highlighted that several members of the CNM They understood them as ponderable in a less favorable sense. As an example of this, the elements provided in their performance report were taken into account, with the majority of the members of the CNM to the conclusion that his performance was not satisfactory the technical aspects established in the article 2 of Regulation No. 1-25, for the assessment of the performance of the judges of the Supreme Court of Justice“.

Second position:

Some counselors highlighted that the magistrate Moisés Ferrer Landrón has maintained a track record of efficient performanceproductive and committed to institutional objectives of the Supreme Court of Justice.

They noted that he has been a speaker in more than four hundred and fifty (450) draft decisions in the Second Room and has actively participated in the resolution of more than two thousand (2,000) files in the Third Roomevidencing a notable capacity for work and technical knowledge in different areas of law.

Likewise, they highlighted their representation of the Judiciary in highly relevant national and international forums, including the Land Conference of the World Bank (2025, Washington, DC) and the Conference of the Judiciary (2024, Santo Domingo), spaces in which he contributed his experience in matters of jurisdictional management and in the institutional strengthening of the Dominican justice system.

“The vote of Judge Moisés Alfredo Ferrer Landrón obtained a qualified majority of unfavorable votes (…) He CNMby virtue of article 181 of the Constitution, Law number 138-11 and Regulation number 2-25, after having evaluated the performance reports and the considerations expressed in the deliberation, decides not to approve the assessment of performance of the magistrate Moisés Alfredo Ferrer Landrón, and, by way of consequence, not ratify it in their functions, considering that the results do not reach the required standards of suitability and performance, as provided by the article 35 of Law 138-11″, is established in the document of the CNM.

Not ratified because of his age

In the case of the judge of the Third Room o Land, Labor, Tax Litigation and Administrative Litigation Chamber, Manuel Alexis Read Ortizit was considered that due to the proximity to the retirement age obligatory, of 75 years for the judges of the SCJcould not be ratified for another period because, “if it were benefited” with the confirmation“would serve less than 30% of the time provided for by Article 181 of the Constitution for the position.”

Six of the eight votes only took that aspect into account. The only two votes that favored him They highlighted that Read Ortiz “is distinguished by his contributions of indisputable institutional and legal significance. Under – he continued – his presidency, the Third Room resolved a historical accumulation of more than five thousand (5,000) files, some pending since 1984, ensuring that said Chamber does not currently register cases without a decision that exceed one year. This result was considered a relevant milestone, as it restored the credibility of the judicial system and became a concerning for other jurisdictions”.

Read Ortiz was also section of the Supreme Court of Justice.
