The TSJ imposed a $10 million fine on Tik Tok

The social network Tik Tok must cancel a fine of 10 million US dollars to the National Telecommunications Commission (Conatel) for its negligence in controlling content and “viral challenges” that invite children and adolescents to cause harm to themselves, the court ruled. constitutional chamber of the Supreme Court of Justice.

In the decision, read this Monday by the president of the Constitutional Chamber of the TSJ, magistrate Tania D’Amelio, it is established that the aforementioned social network has a period of 8 days to cancel the aforementioned amount. In the event that the deadline is not met, “the Constitutional Chamber of the TSJ may take the measures it deems appropriate in this case.”

This money, according to the ruling, must be paid to Conatel, who will have the responsibility of creating a fund to care for family members and victims of the so-called viral challenges.

“This fund will be intended to compensate for the psychological, emotional and physical damages to users, and especially if they are children and adolescents,” indicates the text read by D’Amelio.

Likewise, the TSJ ordered Tik Tok to install an office within our territory, so that the application of technological tools can be supervised and controlled in accordance with our legal system.

Also, the TSJ ordered the formation of a technical panel with the relatives of those aggrieved by the viral challenges “in order to quantify the damages due to the facts proven in the present case and which include tragic and fatal consequences for the victims.”

It is worth noting that the decision of the TSJ It comes after State and civil society organizations filed an appeal for protection before the highest court in the country due to the appearance of viral challenges on Tik Tok and the fatal victims they left in the country.
