The total number of sentences issued by the Judiciary grew by 23% in 2023

In full reform of the Judicial Branch of the Federation, the National Institute of Statistics and Geography (Inegi) revealed that, during 2023, the Federal Judiciary Council (CJF) issued one million 205 thousand 154 sentences and the state justice powers, 775 1,819, figures that represent an increase of 22.9 and 3 percent, respectively, when compared to 2022.

Of the sentences issued published by the PJF, 99.1 percent corresponded to the Federal Judiciary Council; 0.7 percent, to the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) and 0.2 percent, to the Supreme Court of Justice of the Nation (SCJN).

According to the National Census of Federal and State Justice Administration (Cnijfe) 2024, in Mexico there were 332,306 people prosecuted and/or indicted and/or charged in criminal cases filed during 2023, an increase of 4.3 percent compared to to 2022.

On a national scale, there were 140,584 people prosecuted or charged for whom it was decided whether or not to receive a link to proceedings in the Accusatory Criminal Systems or in the Comprehensive Criminal Justice for Adolescents: of which 24,081 were known. by the CJF and 116,503 by the state judicial powers.

Meanwhile, 81.6 percent were linked to the process, 6.6 percent were not and in 11.8 percent of the cases the type of determination was not identified. Compared to 2022, the number of citizens brought to trial increased 10.5 percent.

Of the total crimes recorded, 31,474 corresponded to the Accusatory Penal System, and 1,174 corresponded to the Traditional System. The 17,409 crimes involving weapons, explosives and other destructive materials represented 53.3 percent of those registered at the federal level.

Last year, 7,760 matters were entered into the TEPJF and 7,355 were resolved. Compared to 2022, the number of matters entered fell 45.2 percent, while resolved matters registered a decrease of 47.7 percent.

According to the challenge medium, the electoral trial represented the highest percentage of the matters entered and resolved by the TEPJF, with 28.2 (2 thousand 188) and 27.9 (2 thousand 165), respectively.

Criminal cases

Of the matters submitted to the TEPJF, 94.3 percent corresponded to electoral matters, and 5.7 percent corresponded to labor matters. Furthermore, regarding the body to which they entered, 58.9 percent were assigned to the upper ward. Of the resolved matters, 48.9 percent (3,598) were not resolved in substance and 51.1 percent (3,757) were.

The total of the sentences issued published by the judicial powers of the states, according to the subject: 43.5 percent were family members; 29.7, civilians; 11.5, commercial; 10.2, penalties; 1.6, labor; one percent, justice for adolescents, and 2.2 were from another subject.

Of the criminal cases submitted to state jurisdictions, 26,311 (10.3 percent) were concentrated in Baja California; 24 thousand 927 (9.8), in Nuevo León and 21 thousand 209 (8.3 percent), in Mexico City.

During 2023, 17,214 jurisdictional matters were entered into the SCJN and 15,023 were discharged, which represents the highest levels since 2019. When compared to 2022, the number of jurisdictional matters entered and discharged increased 20.5 and 9.2 percent, respectively. . Of the jurisdictional matters resolved by the plenary session of the highest court in the country, it is notable that the unconstitutionality actions had an average resolution duration of 372 calendar days; the contradiction of criteria, 265 days, and the constitutional controversies, 218 days.

Regarding the resolved matters, resolved by opinion or by agreement in the plenary session, the first or second chambers, the most frequent type of resolution was the substantive ruling, with 281 thousand 977 and 986 cases, respectively. For other processes, the most frequent type of discharge was disposal, with 10,341 issues.
