According to the opinion -approved by the Chamber of Deputies since the 64th legislature, in 2020-, the repealed Law “contravenes commitments assumed by the Mexican State regarding the protection of journalistic activity and the right to inform.”
This is because the international legal framework to which Mexico adheres establishes that the protection of reputation must be guaranteed only through civil and not criminal sanctions, as established by the repealed Law.
In February, the Morena deputy Bennelly Hérnandez proposed and got the majority of Morena and its allies to approve the opinion in the Governance Commission, to increase economic sanctions against those who commit insults against the President of the Republic.
The fines were quadrupled and increased from a maximum of 1,000 pesos to 4,149.6 pesos.
