The Senate prepares to approve the reform of the Army Discipline Law

Adjustments in 44% of the first circle of the President

The Senate is ready to approve the reform to the Law of Discipline of the Mexican Army and Air Force, in order to establish the obligation of those who integrate the armed forces to respect the human rights recognized in the Constitution and in the international treaties signed and ratified by the Mexican State.

In the opinion of the Commissions of National Defense and Legislative Studies, which was in first reading in the last session, it is pointed out that the reform seeks to harmonize that law on military discipline, with the constitutional reform of 2011, which led to the Magna Carta human rights, as an inherent part of people and the obligation of the authorities to respect, protect and guarantee them.

In this sense, the second article establishes that it is the duty of the superior to educate and direct the military personnel that the nation places under his command, with respect for human rights.

Training not to violate human rights

It is an initiative of the PRI senator Silvana Beltrones, in which the advances that the Ministry of National Defense has had in this area are recognized, such as the creation in 2008 of the General Directorate of Human Rights, considering within its specialized structures international humanitarian law and gender equity. All the members of the Army, Air Force and Navy of Mexico are trained in everything related to not violating human rights. The Military Justice Law is clear in this regard..

The ruling commissions considered that the changes to the Disciplinary Law of the Mexican Army and Air Force are of utmost importance for development with a humanistic approach to the regulatory framework of the armed forces.

They are needed to legally order respect for human rights and join the efforts of the Ministry of National Defense, which has published Manuals on Human Rights and International Humanitarian Law, which to date are matters of promotion and training for military personnel.
