The Senate endorses the reform that extends the military presence in security to 2028

Adjustments in 44% of the first circle of the President

After the endorsement of 20 state congresses, the Senate issued the declaration of approval of the constitutional reform that extends the presence of the armed forces in public security tasks until 2028 and sent it to the Official Journal of the Federation For publication.

The Board of Directors counted the approving votes of the congresses of Baja California, Baja California Sur, Campeche, Coahuila, Colima, Chiapas, Hidalgo, State of Mexico, Michoacán, Nayarit, Oaxaca, Puebla, Quintana Roo, San Luis Potosí, Sinaloa, Sonora, Tabasco, Tamaulipas, Veracruz and Mexico City.

In addition, he announced that the non-approval vote of the Congress of Guanajuato was also received.

After that, Alejandro Armenta Mier issued the constitutional declaration approving the reform to the transitory fifth article of the decree by which various provisions of the Political Constitution regarding the National Guard are reformed, added and repealed, published in the Official Journal of the Federation on March 26, 2019.

Thus, during the nine years following the entry into force of said decree, while the National Guard develops its structure, capabilities and territorial implementation, the President of the Republic will be able to dispose of the permanent armed force in public security tasks.

In accordance with the terms established by the Supreme Court of Justice of the Nation, this participation must be extraordinary, in such a way that the absolute necessity is proven, that it be temporary and expressly requested and justified by the civil authority.

Regulated, so that it complies with strict adherence to the legal order provided for in the Constitution, in the laws that emanate from it and the international treaties that are in accordance with it.

Supervised, so that there is constant review or supervision of the institutional operation, through accountability; subordinate and complementary, in such a way that the support tasks that the armed forces provide to public security institutions can only be carried out in their aid or complement, and are founded and motivated.

The reform establishes, among other points, that the actions carried out by the permanent armed force will in no case be intended to replace the civil authorities of other orders of government in the fulfillment of their powers or exempt said authorities from their responsibilities.

The second transitory article establishes that as of fiscal year 2023, the Federal Executive will establish a permanent fund to support the states and municipalities for the strengthening of their public security institutions.
