The Public Ministry issued a regulation with instructions that aims to standardize and optimize fiscal action in the investigation of crime in coordination with the National Police (PNP).
However, they ratified their institutional position on the exclusivity of the conduct and direction of the investigation of the crime, which the Constitution has conferred upon them since its inception.
For this reason, said measure was adopted while the unconstitutionality action filed against the legislative decrees that grant the National Police the power to direct preliminary investigations of crimes is being resolved.
As recalled, the Executive Branch decided to promulgate Law 32130 on October 10, approved by Congress, which modifies the Criminal Procedure Code to strengthen crime investigation as a function of the PNP and expedite criminal processes.
According to the aforementioned rule, the Public Ministry will assume the legal conduct of the investigation, this in turn implies the legal orientation of the actions carried out by the PNP to obtain elements of evidence for the investigation.
