The Police raided the Azul FM studios for broadcasting audios with sexual content

On Wednesday, February 2, the journalist Ignacio Álvarez made a report on his program “La pecera”, which is broadcast on radio Azul FM, about the rape complaint made by a 30-year-old woman and involving three young men.

During the program, the journalist broadcast different audios (extracted from a video that one of those involved would have filmed) of intimate and sexual content that suggested that the relationship would have been consensual.

The Attorney General of the Nation, Juan Gómez, ordered ex officio that the 6th Shift Sexual Crimes Prosecutor’s Office initiate a criminal investigation for the disclosure in the aforementioned program of the audios of intimate content, linked to the case of the rape complaint.

The decision is based on the fact that the disclosure of the audios could violate article 92 of the Gender Law, which establishes: “Whoever disseminates, reveals, exhibits or transfers to third parties images or recordings of a person with intimate or sexual content, without your authorization, will be punished with a sentence of six months in prison to two years in prison. In no case will the authorization granted by a person under 18 years of age be considered valid. This crime is configured even when the person who disseminates the images or recordings has participated in them. The administrators of Internet sites, portals, search engines or the like who, notified of the lack of authorization, do not immediately remove the images, will be sanctioned with the same penalty provided for in this article.

This Friday, the Police raided the Azul FM studios for the broadcast of audios that were in digital format.

Hours earlier, the prosecutor Sylvia Lovesio managed to charge the three older men, between 18 and 19 years of age, with preventive detention for the crime of “particularly aggravated sexual abuse”, and one of them, in addition, was charged for the dissemination of material with intimate and sexual content without the authorization of the victim.

The prosecutor said that the audios broadcast on the radio were “fragments” and “did not distort the body of evidence.” In addition, she regretted that “relative minors” (between 18 and 19 years old) committed “a crime of such magnitude and barbarism.”
