This Tuesday the justice accepted the request of the defense of the Argentine Nicolás Rocca of change the pretrial detention so that he can serve it at home, after he was indicted on February 15 for a complex crime of culpable homicidereported to The Observer defendant’s defense.
Rocca was one of the drivers of the traffic accident occurred in springs where they died two models also from Argentina. Designated as responsible for the accident, Rocca He was placed in pretrial detention for 45 days.
According to the imputation request to which he agreed The Observer and which was presented in court in mid-February, Rocca –who was driving a Volkswagen Nivus van– had consumed “alcohol and narcotics” before starring in the accident.
For prosecutor Sebastián Robles -based on a report from the Scientific Police Accident Department-, the Argentine driver was going to a “higher speed than allowed” by route 104 from north to south, “when at kilometer 1 he changed path completely invading the oppositecolliding head-on with a vehicle traveling in the opposite direction.
He also relied on the statements of the survivors of the accidentthe surveillance camera records of the place, the call 911 that was made after the crash, the photos of the accident and toxicological examination de Rocca and his spirometry.
The Argentinian Driver had already received a number of judicial precautionary measures: he had to hand over his travel documents, he was prohibited from leaving the country and also from communicating or approaching the others involved in the accident.
On the morning of this Tuesday, during a hearing, justice accepted the request of the defense of the Argentine, so that the rest of Rocca’s 45-day preventive detention could be served at home.
