The president of the Senate promulgated the law that ends the mandate of the highest judicial authorities since January of this year. The decision is carried out, according to the promulgated norm, by virtue of the mandate of the Political Constitution of the State, which establishes that the function of the magistrates is six years, therefore it invalidates the abusive self-extension that they established as a judge and part. Thus an action questioned by political organizations and civil society ends.
The Political Constitution of the State, in its articles 183, 188, 194 and 200, clearly states that the Magistrates may not be re-elected. His term of office will be six years. This rule applies to the high authorities of the Supreme Court of Justice, the Agro-Environmental Court, the Constitutional Court and the Judicial Council.
If the situation is seen from the application of the Constitution, the self-extension was a violation of the Magna Carta, even though the argument was that the country could not be left without authorities in those high courts. It must be remembered that these TCP magistrates issued more than 50 constitutional protections aimed at hindering the holding of the Judicial Elections in 2023, as it should have been in a state of law.
All of this gave rise to the aforementioned self-prorogation that had turned the authorities of the Constitutional Court into untouchable and all-powerful, since through constitutional rulings they blocked everything that hindered its members and the power of Luis Arce in the Executive.
The wording of the law clearly indicates that, in the absence of the president, the vice president takes over; while the head of the Senate (in this case Andrónico Rodríguez) remains as head of the Legislative Branch, with the power to enact the law in question.
If there was any doubt about the collusion between the magistrates of the Constitutional Court and the archism, it is cleared up after learning of the immediate reaction of deputy Juan José Jáuregui who announced a criminal case against the president of the Senate for promulgating that law, indicating that his action It is a disobedience to constitutional resolutions.
The question then is, if the Constitutional Court issues rulings that go against the Constitution, what is the way to stop it? Or who defends the people from the abuse of these magistrates?
It must be remembered that the self-prorogators attacked democracy with the decision to remain in office despite the Constitution; Later they annulled sessions of the Legislative Branch and recently suspended the election of authorities of the Supreme Court of Justice and the Constitutional Court in five departments. With impudence, two members of the fourth constitutional chamber: Iván Espada and Gonzalo Hurtado, continued to extend their functions, thereby acquiring unlimited power, under the argument that they were enforcing the Magna Carta.
What was done by the president of the Senate, within the framework of the vote that took place in the Legislative Assembly, reorganizes the institutions, the separation of powers and respect for democracy. This time he did it without the arcismo having time to turn off the light and boycott the session, as it did months ago when a similar rule was approved, which was hastily annulled by the self-prorogators, who felt affected.
The law promulgated by Andrónico Rodríguez establishes that the magistrates fulfilled their mandate at the beginning of this year and ratifies that situation, meaning that sentences approved after that date would be null. In this way, for example, the Arcist MAS Congress would not be validated.
Although it is part of the internal struggle of the party as Government, it should be noted that Bolivians are freed from the constant threat of magistrates willing to rule on any issue, as long as it benefits them and favors the interests of Luis’s political power. Maple.
The greatest good is democracy. Citizens must be aware of this and defend it from any maneuver that seeks to curtail citizen rights and the Magna Carta.
