The justice of Bariloche, in the province of Río Negro, ratified this Monday a 2013 ruling that orders the reopening of the access road to the hidden lakewhich was fenced by the English businessman Joseph Lewis, who has land near the lake.
The order ratifies the sentence of civil judge Marcelo Cuellar, who in February 2013 ordered the provincial government to carry out the necessary work in area to ensure transit hidden lake through the Tacuifi road.
The new sentence to reopen the passage to hidden lake It was made by the Chamber of Appeals in Civil, Commercial, Family, Mining and Administrative Litigation of Bariloche, made up of judges Marcela Pajaro, Jorge Serra and Federico Corsiglia.
The Chamber also ruled that the provincial authorities have a period of three months to carry out the necessary works to enable transitthrough Vialidad Rionegrina and the Provincial Council of Ecology and Environment (CODEMA).
In addition, it granted the same time for the province to implement “all the corresponding administrative actions, with the aim of avoiding inconveniences or threats to those who want to enter a public domain asset.”
The resolution was signed on September 12, by judges Marcela Pájaro and Jorge Serra with the dissenting vote of judge Federico Corsiglia. Judges weighed in on the case after numerous appeals were filed by the Río Negro province and Hidden Lake SA (owned by Joe Lewis) against the 2013 ruling.
Although the Río Azul-Lago Escondido Natural Protected Area was created in 1994, in 1999 the limits of the area were modified and left to the lake outside the protected area.

In this regard, the representative of the Assembly for Human Rights and judge of the Bariloche Chamber of Labor, Rubén Marigo, expressed “I want to highlight the medullary ruling of Dr. Marcela Pájaro, to which Jorge Serra adhered with grounds, making this request effective of the entire society, given the need to put in conditions and carry out the necessary works on the Tacuifí road, as well as on the mountain road, and carry out the works that correspond to it”.
