The Judiciary will be notified with the decision of the Inter-American Court of Human Rights (Court-IDH) that requires the Peruvian State to suspend the release of convicted former President Alberto Fujimori ordered by the Constitutional Court (TC).
This was stated by the supranational prosecutor Carlos Reaño in dialogue with this Peru21. “In the following minutes, the competent institutions will be informed of this decision; the Judiciary is one of them since it was this body that processed the habeas corpus”, he stated.
It was the Fujimori lawyer Gregorio Parco who filed habeas corpus in favor of the former president in a court in Ica, in 2020. Two years later, a majority of TC magistrates decided to grant the appeal and release Fujimori, sentenced to 25 years in prison for the crimes in the Barrios Altos and La Cantuta cases.

Reaño indicated that the TC and the National Penitentiary Institute (INPE) will also be notified of the statement, the latter because it administers the prison in which the former head of state is being held.
“Article 63 of the American Convention and article 27 of the I/A Court regulations, the Peruvian State has to abide by the decisions of the plenary session, and in this case it is presented as one of the provisional measures within the process of supervising compliance of sentence”, said the prosecutor.
The ruling of the TC, published last Monday, restores the pardon granted to Alberto Fujimori in December 2017 by then President Pedro Pablo Kuczynski.
That presidential grace, however, was annulled the following year by Supreme Judge Hugo Núñez. Despite this sentence, the magistrates Ernesto Blume, José Luis Sardón and Augusto Ferrero concluded that the pardon was not illegal, as Núñez pointed out, and annulled that resolution.
The supranational prosecutor explained that the resolution of the Inter-American Court has not yet been notified, but indicated that in the next few hours it will be done to find out if there are other additional provisions.
