The Judiciary ordered the National Board of Justice (JNJ) to reinstate Delia Espinoza Valenzuela in the position of national prosecutor within a maximum period of two days, so that she can continue exercising her functions immediately.
The decision was communicated through a judicial resolution declaring the validity of Agreement No. 6579-2024 of the Board of Supreme Prosecutors and Resolution No. 058-2024-MP-FN-JFS, documents that had formalized his designation in the Public Ministry.
According to the document, the judicial instance establishes that it is up to the summoned entity, in this case the National Board of Justice, to abide by the resolution and proceed with the reinstatement of Espinoza in office.
Furthermore, the JNJ is urged to comply with its duties inherent to correct procedural conduct, reminding it that judicial decisions must be respected within the framework of the rule of law.
After learning of the resolution, Delia Espinoza’s lawyer, Luciano López Flores, stated through his official account on
“The 9th Constitutional Court of Lima has just notified me with the resolution that, by establishing that the JNJ failed to comply with its precautionary mandate, it orders to suspend the measure that the JNJ issued against Dr. Delia Espinoza,” said the lawyer.
López also indicated that, although the judicial resolution expressly orders the reinstatement of Espinoza as Prosecutor of the Nation, said mandate would be “unofficial”, since the suspension of the preventive measure that separated her from the position automatically restores her status as Supreme Prosecutor and, therefore, her quality as Prosecutor of the Nation. “We will ask for clarification,” he added.
