After the spurious “judicial resolution” issued on June 9 by Criminal Chamber 1 of the Managua Court of Appeals (TAM), under the command of the servile magistrate of Daniel Ortega, Octavio Rothschuh, ordering the confiscation of all the assets of the 222 Former politicians exiled to the US, a group of those patriots issued a statement denouncing the fact that they classify as “judicial lynching of opponents.”
The pronouncement signed by 84 of the 222 released and exiled politicians denounces that the resolution issued by Criminal Chamber 1 of the TAM confirms what has always been denounced: that the Nicaraguan Judiciary is an instrument of repression at the service of the dictatorship. Ortega-Murillo.
They recall that the 222 political prisoners were tried in «violation of the guarantees of due process, with accusations of false facts; with evidence fabricated by the Police and the Public Ministry in quick and secret hearings, without access to their lawyers and with concealment of the causes from the defenses”, and they insist that “the guilty resolutions were equally illegitimate and the processes void”.

The Ortega judges who heard the cases against all the prisoners of conscience violated the universal principle of “in dubio pro reo”, by which a subsequent rule can only be applied when it benefits the prisoner. “Both the alleged crimes, as well as the penalties that are still being sentenced through resolutions in legally terminated trials and illegally kept open, did not exist in Nicaraguan legislation at the time of the final sentence,” highlight the 222 exiled patriots.
Even with all this accumulation of illegalities, the expatriated opponents denounce, the resolution of June 9, issued months after the final sentence, once again penalizes the 222 with the “immobilization and confiscation in favor of the State of all their real estate and actions, in their personal character or as a legal person”, which violates another “universal and fundamental principle of law” that promulgates that the penalties do not transcend the person of the convicted person, however, the dictatorship snatched the assets of entire families.

“The illegal confiscation is equivalent to the distribution of the loot that criminals carry out at the end of the commission of their crimes, appropriating the product thereof, and confirms the relationship between violation of human rights and corruption,” say the confiscated.
Finally, they call on the Nicaraguan people “not to give up, preserving faith in change, because so many injustices have no possibility of sustaining themselves over time.”
