On September 15, President Andrés Manuel López Obrador will enact, as he announced this week, the reform to the Federal Judicial Branch (PJF) that allows the election of judges, magistrates and ministers by popular vote, thus achieving the most relevant modification to the country’s legal structures.
After the Senate formulated the declaration of constitutionality of the aforementioned reform on Friday, after 23 local congresses voted in favor of that project, the Chamber of Deputies also did the same, so the legislative process was closed and the amendment was sent to the Executive for publication in the Official Journal of the Federation.
Its issuance by this federal government body is expected today, when the 214th anniversary of the beginning of the struggle for Independence is commemorated. However, its entry into force would occur amidst arguments against it, since the second district court based in Colima granted a suspension against the publication of the decree, which proposes to reform, add to and repeal various provisions of the Constitution related to judicial reform.
In light of this, this Friday, the president of the Senate’s Constitutional Points Commission, Ernestina Godoy (Morena), warned that the protection granted by the Colima judge to prevent the PJF reform from being enacted would not proceed, and emphasized that said defense measure is notoriously inappropriate
.
The response of some sectors of PJF workers has also been against, after the National Association of Circuit Magistrates and District Judges agreed to maintain the work stoppage in all PJF bodies.
With the application of the constitutional reform to the PJF, an extraordinary election will be held in 2025 to renew all ministers, judges and magistrates. Those who currently hold office will be able to participate in this election on equal terms. As for the 1,633 circuit magistrates and district judges, they will be elected in each of the 32 judicial circuits in ordinary elections.
In addition, there will be a new composition of the Supreme Court of Justice of the Nation, the replacement of the Federal Judicial Council and new procedural rules.
