"The judges cannot control the legitimate power of the Executive," says US vice president

In an X publication on Sunday, Vice President JD Vance questioned the power of a federal judge about the Executive Power after Elon Musk was prevented from accessing the Payment System of the Treasury Department.

“If a judge tried to tell a general how to carry out a military operation, it would be illegal,” Vance said in his publication. “If a judge tried to order the attorney general how to use his discretion as a prosecutor, that is also illegal. Judges cannot control the legitimate power of the Executive. ”

In the American system, it is based on the separation of powers.

The publication triggered a rapid response from some Democrats, who criticized Vance for ignoring how the ESO separation of powers in the United States Constitution works.

That “is called the rule of law,” said Congressman Daniel Goldman in response.

Musk asked on Sunday to replace a judge.

“Yale’s faculty should be ashamed,” said Engier John Yarmuth.

“The legal role of the judge is to define which executive powers are legitimate. It is called the separation of powers, in what you apparently do not believe, ”he concluded.
