In an X publication on Sunday, Vice President JD Vance questioned the power of a federal judge about the Executive Power after Elon Musk was prevented from accessing the Payment System of the Treasury Department.
“If a judge tried to tell a general how to carry out a military operation, it would be illegal,” Vance said in his publication. “If a judge tried to order the attorney general how to use his discretion as a prosecutor, that is also illegal. Judges cannot control the legitimate power of the Executive. ”
In the American system, it is based on the separation of powers.
The publication triggered a rapid response from some Democrats, who criticized Vance for ignoring how the ESO separation of powers in the United States Constitution works.
