Efraín Suárez, Advisor for Institutional Management of the Santa Cruz Governor’s Office, distorted the statements of the Minister of Justice, Iván Limawho asked that Luis Fernando Camacho Vaca be removed from his position as governor because he is “absent” due to his preventive detention in the La Paz Chonchocoro prison.
“Both the lieutenant governor and the Legislative Assembly must make a legal analysis and make determinations (…). The concept of absence of the governor is legally established given the preventive detention that he has at this time, “said the minister.
Lima said that the current autonomous statute establishes in its articles 25 and 26 the causes of the absence of the elected authorityas it happens with Camacho, investigated for the so-called ‘coup d’état I’ case, in which he is accused of the alleged crime of terrorism.
Lima remarked that “If they decide that there is no absence, that the governor is in Santa Cruz, they will be crashing with reality and that is not an admissible possibility ”.
For his part, Efraín Suárez said that Iván Lima erroneously referred to the articles of the autonomous statute and I accuse the national government of confusing the population with illegal arguments.
“The Minister of Justice referred badly to the autonomous statute, which establishes in its article 26 that the governor loses such quality on four occasions; in cases of resignation, death, by a revocation, or by an enforceable sentencenone of which have been fulfilled with Camacho”, explained the Institutional Management adviser of the Government.
Suárez said that the governor does not have an enforceable sentence against him and that does not comply with the concept of “temporary absence”, that Minister Lima argues. “Temporary absence is defined by law, not by a minister, and it is not defined beyond the statute. The temporary absence established by the Civil Code indicates that this occurs when this person is not known, ”he explained.
Therefore, Suárez ratified that Luis Fernando Camacho remains the first authority of the department Cruceño “because the norms establish it that way”, in addition to the fact that the four situations that the autonomous statute indicates for him to lose his position are not met.
“Democracy is at stake. There is a process invented because there was fraud and they have kidnapped him and taken him to Chonchocoro from where he exercises (the position of governor) and now the Government does not want him to continue being so because wants to finish consolidating a blow to democracya blow to the Santa Cruz Governor’s office,” Suárez refuted.
