The Institute of Security and Social Services of State Workers (Issste) filed four criminal complaints with the Attorney General of the Republic (FGR) that implicate Jorge Gurrola García, former head of the legal unit of that institution, as allegedly responsible for various crimes. agency in its delegation from the state of Durango, officials of the Federal Board of Conciliation and Arbitration and trial lawyers, for being involved in the illegal granting of 67 pensions that represent a patrimonial damage to the institute for more than 2 thousand 987 million pesos.
The complaints were filed last Monday, and in them the Issste representatives indicated the number of pensions that the agency must pay because the members of the Legal Unit in charge of Gurrola García incurred in irregularities, omissions and collusion with litigants.
According to information obtained and based on the briefs presented, Gurrola García served as head of the Issste legal unit in the Durango delegation, since 2015, and was relieved in 2019.
During that period, dozens of applications were submitted for the payment of pension increases, and among the arguments put forward by legal offices, the inclusion of the so-called guaranteed compensation was requested – a benefit that by decision of the Supreme Court of Justice of the Nation ( SCJN) should not be considered in the pension amount – and the retroactive coverage of various benefits, and for this purpose, documents were falsified, the lawsuits were filed with the Conciliation and Arbitration Board number 42 based in Torreón, Coahuila, and it admitted them, violating the norms that establish that the cases should be settled before the Federal Court of Administrative Justice.
The legal offices that took on the cases therefore obtained between 35 and 40 percent of the amounts won, since in the 67 cases the lawsuits were lost because the Issste legal representatives did not present arguments.
The complaints indicate in the first case the illegal granting of 42 pensions, which generated a financial impact of one thousand 185 million 994 thousand 360 pesos; in another, the complaint was made due to the detection of 16 cases that had an affectation of one thousand 131 million 545 thousand 532 pesos; the third refers to five trials in which the Issste was forced to pay 581 million 766 thousand 873 pesos, and in the fourth complaint, for four trials the institute had to cover 88 million 257 thousand 980 pesos.
