As announced, the Government officially presented to Congress the draft of impeachment against the Supreme Court of Justice, promoted by President Alberto Fernández and governors.
The initiative was presented by legislators from the Frente de Todos (FdT), who also asked to summon magistrates Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti to appear to testify before the Commission, who will be charged with advancing with the request for impeachment.
Parallel to this, the Government also formalized the call for extraordinary sessions between January 23 and February 28, in order to deal with the request for impeachment against the Court and another 26 projects of great relevance to the country.
In the document presented by the pro-government bloc, they state that: “The Supreme Court of Justice of the Nation, made up of doctors Horacio Rosatti, who exercises the presidency of the body, Carlos Rosenkrantz, Ricardo Lorenzetti and Juan Carlos Maqueda, has carried out arbitrary attacks on the constitutional powers assigned to the National Executive Power and the National Legislative Power”.
This means that “they have breached the constitutional obligations they are in charge of, incurring in the cause of poor performance provided for in article 53 of our National Constitution,” according to the text.
In this sense, they maintain that “the impeachment that is promoted turns out to be a constitutional process carried out by a constitutional body with a specific and exclusive function, such as that of analyzing the political responsibility of the accused magistrates and judging whether they still maintain the necessary suitability to continue adequately exercising the position they hold and, in this way, guarantee the institutional quality, legitimacy and credibility of the Judiciary”.
And they stress thatthe process that is promoted has the purpose of protecting the constitutional principle of suitability -both technical and ethical- of the magistrates in the performance of their positiona characteristic that must remain throughout his exercise and that, as such, and attentive to the admitted causes, covers not only the cases of poor performance in the exercise of the function, but also those conduct disorders that affect the personal investiture of the magistrate and they extend the affectation to all the judicial magistracy”.
Other summoned
In its document, the FdT requested that more than 40 people give testimonial statements, including Silvio Robles, Rosatti’s adviser, and Marcelo D’Alessandro, Buenos Aires Minister of Security on license, who staged a scandal after a chat leak .
In addition, they summon “all the directors, secretaries, officials and/or employees of the Supreme Court of Justice of the Nation who have had intervention and/or could provide information of interest regarding the facts denounced”.
