The government must proceed “to act against judges” like Pablo Gómez Fierro

The Federal Judiciary Council (CJF) has its own means of control to investigate justice officials who have committed an irregularity, as long as they are reported, said sources from the Judiciary.

They said that at the moment no authority has filed complaints against economic competition magistrates, including Juan Pablo Gómez Fierro, who in recent months have granted suspensions to companies that stop federal government initiatives. They pointed out that he must present the demand with the evidence before the CJF. “Since judges and magistrates are public officials, there is a thesis in the Supreme Court that says that public officials or servants are more exposed to criticism. If the President says that they are going to investigate them, since there is no direct action, it is only a statement and no recourse is appropriate.

In the event that the Executive decides to act, it must present the complaints or investigations to the corresponding authorities, because in the end all this has to reach the CJF in a file. Subsequently, the Surveillance Commission has to vent them. There is a specific unit that validates whether or not to initiate the corresponding investigation, but first it is presented to the full body for approval.

They recalled that in the case of Gómez Fierro, the authorities had already requested to investigate him, but the Judiciary found no links between the togado and interest groups to resolve their rulings.
