The political future of Cristina Kirchner (CFK) is at a crossroads after the confirmation of his six-year prison sentence and perpetual disqualification from holding public office for the public works case in Santa Cruz.
This situation raises questions about the possibility of Cristina Kirchner to run in future elections, especially considering the judicial record in Argentina. In 2013, the National Electoral Chamber revoked the candidacy of Raúl Romero Feris, who was running for national senator for Corrientes.
Romero Feris had been convicted of embezzlement of funds in the construction of a track for the troupe parade and for the irregular sale of public bonds. The Electoral Chamber argued that the conviction, although not final, violated the principle of suitability required to hold public office according to article 16 of the National Constitution.
In 2017, the same Chamber revoked the candidacy of former president Carlos Menem, who sought to be re-elected as senator for La Rioja. Menem had been convicted of arms trafficking to Croatia and Ecuador and for paying bonuses to officials of his government.
As in the case of Romero Feris, the Electoral Chamber considered that the conviction, although not final, affected the necessary suitability to be a candidate. Despite the revocation of his candidacy in 2017, Menem managed to run again in 2019. On this occasion, the Supreme Court of Justice of the Nation intervened and allowed his candidacy, arguing that the conviction was not final and, therefore, the disqualification sentence could not be carried out.
This ruling set an important precedent, as it allowed Menem to compete in the elections and be re-elected as senator. The confirmed sentence C.F.K. by the Federal Oral Court 2 includes a sentence of six years in prison and perpetual disqualification from holding public office.
Conviction
This conviction is based on the crime of fraudulent administration to the detriment of the public administration, related to the awarding of public works in Santa Cruz to Lázaro Báez companies. From a criminal point of view, Cristina Kirchner She could not be a candidate if the conviction is final, since the prison sentence and perpetual disqualification would be carried out.
However, for this to happen, the Supreme Court of Justice of the Nation must intervene and confirm the conviction. The deadlines for this intervention could exceed next year’s elections, opening the possibility that CFK could run in the meantime.
