The expulsion of José Laluz from the PLD is official

Santo Domingo.- The National Court of Discipline and Ethics of the Dominican Liberation Party (PLD) ordered the expulsion of the communicator José Laluz from that organization, “by virtue of his tacit and notorious resignation.”

By resolution, the PLD disciplinary body orders the Organization Secretariat to separate it from party records, including its membership in the Central Committee.

The National Court of Discipline and Ethics is chaired by Alejandrina Germán, and is also made up of John Garrido, Manuel Galván, Luis García, Elic Fernández, Teodoro Ursino Reyes and Gustavo Guzmán.

It refers that the body has had access to various videos and audios in which Laluz Núñez expresses herself in the sense that she no longer belongs to the PLD, “markedly acid pronouncements and even, to a certain point, disrespectful towards the Dominican Liberation Party already its leadership.”

The affiliation to a political party is the free and voluntary manifestation of a citizen to belong to a political organization, he adds, and with this to participate democratically in the political life of the country.

It specifies that, in the same way, all members of a political party, group or movement have the right to resign at any time, without giving cause, in accordance with the provisions of paragraph I of article 7 of Law No. 33-18, on Parties, Groups and Political Movements.

It refers that for the resignation of a member to operate, it is not a sine qua non condition that it has been submitted in writing to the competent authority, “especially when such resignation constitutes a notorious fact, as in the case of Mr. José Felipe Laluz Núñez, who has not only publicly referred to her tacit resignation from the Dominican Liberation Party, but has even done so musically, dedicating a rap referring to pronouncements against the organization and expressing her departure.”

Regarding a notorious fact, the resolution of the National Court of Discipline and Ethics of the PLD emphasizes several jurisprudence, among them the ruling of the Constitutional Court C-086/16, of February 24, 2016, when it states that “it is about any event known by all members of the social network, about which there is no doubt or discussion; in this sense, it is exempt from evidence, since it is part of the public domain”.

The resolution points out that the actions of former deputy José Laluz constitute a bad example for current and future members of the PLD.

The aforementioned Court notified the decision to Laluz by means of a formal act of the bailiff, as well as to the partisan instances.
