On rainy days, the streets become a complicated scenario for both drivers and pedestrians. But while those who go behind the wheel are protected inside their vehiclespeople who move on foot are exposed to endless inconveniences. One of the most annoying – and sanctioned by law – is to be wet by a car that passes at high speed on a puddle.
Although many see it as an oversight or a mischief without consequences, wetting a pedestrian on public roads constitutes an infraction in Chili. According to Traffic Law 18,290, drivers should prevent the water from the road from splashing the sidewalk or those who walk through it. Ignoring this obligation can bring economic and legal consequences.
A less serious infraction with a fine of nothing less
Article 122 of said law states that drivers must act with caution against puddles, taking care not to wet pedestrians. If this standard is infringed, the fact is cataloged as a “less serious contravention” according to article 199. Even so, the sanction can be considerable: it goes from 0.5 to 1 monthly tax unit (UTM).
Considering the current value of the UTM, the fine can range between $ 34,392 and $ 68,785 Chilean pesos. A figure that far exceeds what many imagine by committing this type of act, apparently harmless.
How can the driver be denounced
People who are wet by a vehicle have the right to make a formal complaint. For that, the first thing that is recommended is to register the patent of the car involved. If possible, it may also be useful to take a photo or video of the fact, as well as write down the exact time and place where it happened.
Once the information has gathered, the next step is to approach a police station and file the complaint. In some cases, urban surveillance cameras can help confirm the data and support the claim.
The responsibility belongs to everyone
This type of infractions not only highlights the lack of empathy at the wheel, but also the ignorance of basic road coexistence norms. Driving implies not only those who go in other cars, but also to those who mobilize on foot, especially in adverse climatic conditions.
