The decree that massifies strikes is an attack on the CNT, according to businessmen

The United Entrepreneurs for Peru group, which brings together more than 200 unions, warned that Supreme Decree 014-2022-TR, which modifies collective labor relations, facilitates strikes and empowers unionized workers, will have a high negative impact on the productive apparatus of the country and threatens the ).

“It will generate a series of collateral effects on the generation of employment, the provision of services to the population, environmental pollution, among others,” the statement said.

The representatives of the unions stressed that “this unilateral decision of the Government breaks the National Labor Council, since it was not debated in this tripartite instance of dialogue and social agreement made up of workers, employers and the Government.”

In this regard, the president of Confiep, Oscar Caipo, referred in Peru21 that in the last session of the CNT (July 18) the preliminary draft of the Labor Code was discussed as the third point of discussion, which includes in one of its union relations chapters, and condemned that the MTPE has skipped this dialogue process with this decree. “This just shows authoritarianism and one-sidedness,” he protested.

The labor lawyer Germán Lora pointed out that the DS violates labor legislation and violates the Constitution because with a regulatory norm, aspects that are not in the law are being included. In that sense, he indicated that what corresponds is to propose amparo, popular and precautionary measures.

IT’S NOT THE FIRST TIME

The United Entrepreneurs for Peru group recalled that this is not the first time that this Government has acted unilaterally, without discussing projects of labor importance with the social partners, since the same thing happened with the DS on labor outsourcing.

Former Vice Minister Javier Dávila, who was part of one of the CNT tables, added that the increase in the minimum living wage was also approved without being consulted in the tripartite council.

For Caipo, the Government “is kicking the table of the dialogue of the CNT for particular interests with the unions in order to obtain political support in its desperation due to the questions and corruption scandals.”

The business leader announced that all available legal channels are being analyzed to curb the norm, which, he remarked, has overtones of arbitrariness and unconstitutionality.
