The court assessed three requests made by Nallar in his action for freedom

Right to life, due process and the right to defense were the three arguments used by Misael Nallar’s defense and that were assessed by the three judges of the Seventh Sentencing Court of Santa Cruz, the same ones who granted the claims and instructed to review the first judicial ruling that ordered the remission of the detainee to the prison of Chonchocoro in La Paz.

“According to what has been allowed to be read, this court, it has not been possible to establish clearly that it has been fulfilled these budgets given that he has not yet entered the Palmasola prison, ”says part of the judicial resolution.

Early this Saturday, Judge Rodrigo Vedia Espinoza, of the Public, Mixed, Civil, Commercial, Family and Penal Institution Court of La Guardia, ordered that Nallar be confined in the maximum security prison of Chonchocorolocated about 25 kilometers from the city of El Alto.

The defense of the accused resorted to a request that indicates a suspected Nallar cardiac arrhythmia that would put his life at risk, since the prison where he is being held is at 3,879 meters above sea level. Likewise, they affirmed that the prison authorities must be the ones that must guarantee the safety of any inmate, so it would not be appropriate to agree to the pronouncement of the Palmasola inmates. Finally, he assures that the accused has the right to defense and therefore being held more than 800 kilometers away does not guarantee that right.

The three judges who heard the case, Freddy Coronel Alacoma, Yanet Panlaqua Villa and Claret Llanos Martínez decided that the case should be reconsidered and so they ordered Judge Vedia. But the prison authorities explained that the action of freedom granted to Nallar is to be fulfilled during working hours, that is, only business days.

The judicial ruling of the Seventh Court does not refer to what type of medical study presented by Nallar’s defense to ensure that you have a cardiac arrhythmia. In the memorial that they presented for the action, it does not read that there is a medical certificate on that point either.

Misael Nallar is already in the isolation pavilion from the Chonchocoro prison, as far as he arrived on Saturday and the rigorous reviews began so that after two weeks of permanence he is integrated into one of the four pavilions that this maximum security prison has. The defendant’s defense asks that he be sent to the Palmasola prison or, failing that, to the Montero prison, which would be the closest.
