The Supreme Court of Justice of the Nation (SCJN) admitted for processing two claims by the National Electoral Institute (INE) against the suspension that allows the Attorney General of the Republic (FGR) not to deliver a copy of the investigation files initiated against Pío López Obrador, David León Romero and Morena for alleged electoral crimes.
This occurs weeks after the president of the INE, Lorenzo Córdova, criticized the highest court in the country for taking over, he said, as a third instance regarding the decisions of the Electoral Tribunal
.
The underlying issue is the constitutional controversy 6/22, with which the FGR fights a resolution of the Electoral Court of the Judicial Power of the Federation (TEPJF), where it was ordered to deliver to the INE the information on the case, which began with the filtering of videos where both characters receive money, supposedly to finance Morena’s campaigns.
Minister Yasmín Esquivel admitted the controversy for processing and granted the suspension to the FGR, arguing that, if a copy of the investigation folder were delivered to the INE, the right to privacy of those investigated would be violated, in addition to without matter this constitutional judgment.
At the same time, the SCJN announced that the FGR filed a new controversy, 78/22, challenging the TEPJF resolution SUP-JE-39/22, which again orders it to deliver to the INE the information of an ongoing investigation.
As the topic is similar, it was decided that this case should also be assigned to Minister Esquivel’s presentation.
Finally, an agreement was also published where the constitutional controversy promoted by the Chamber of Deputies is discarded, against the resolution of the INE Complaints and Denunciations Commission, with which it ordered President Andrés Manuel López Obrador to refrain from speaking about achievements of government during the revocation of mandate. This is because said process has already concluded and the pronouncement of the SCJN would have no object.
