The Court admits 5 appeals against the judicial reform, but refuses to suspend it

Minister Juan Luis González Alcántara Carrancá admitted the five actions of unconstitutionality against the judicial reform that were promoted by political parties and local legislators, which means that the Supreme Court of Justice of the Nation (SCJN) will analyze the validity or not of the amendment to the Magna Carta.

However, the minister refused to issue a suspension to stop the reform, as requested by the promoters of the resources: PAN, PRI and MC, the Democratic Unity of Coahuila political party and legislators from Zacatecas. The majority challenged the reform, accusing it of defects in its legislative procedure.

“Issue a pronouncement In relation to these aspects, it would imply resolving issues reserved to the merits of the respective unconstitutionality actions, and it could also hinder the ongoing electoral process, which could generate greater social harm than benefit, being a precautionary measure. Consequently, there is no reason to grant the suspension requested by the promoting political parties and deputies,” he justifies.

Likewise, it is ordered to request the Chamber of Deputies, the Senate of the Republic and the local congresses to submit their reports related to the entire reform process; The federal Executive was required to provide a copy of the Official Gazette of the Federation of last September 15, which records the publication of the decree.

He also requested the opinion of the presidency of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), giving them a period of 10 calendar days from the date of notification.

Likewise, the presidency of the National Electoral Institute (INE) was required to, within a period of three calendar days, deliver certified copies of the current statutes and records of the promoting national political parties.

Yesterday, it was also reported in electronic lists of the Court that the Judiciary of Guanajuato promoted a constitutional controversy against the reform of the PJF, an appeal that was turned over to Minister Juan Luis González Alcántara Carrancá, who will decide whether to admit or reject it.

The previous one adds to the controversy 286/2024 that the minister admitted, which was filed by the former governor of Guanajuato Diego Sinhue Rodríguez, just before ending his administration.

Criticism

In a UNAM forum, Minister González Alcántara stated that a person cannot embody the will of the peoplebecause If the government is the representation of the people, is it about protecting the people from themselves? The above is contrary to what the president of Mexico, Claudia Sheinbaum, maintains.
