The Plenary of the Constitutional Convention voted this afternoon and in particular the report of the Environment Commission, after its general vote on Thursday. Of the six articles approved on that occasion, the vote in particular only approved the second paragraph of article 1, on climate and ecological crisis.
The paragraph indicates that “the State will promote dialogue, cooperation and international solidarity to adapt, mitigate and face the climate and ecological crisis and protect Nature.” It had 106 votes in favor, 27 against, 18 abstentions. By overcoming the fence of 2/3 (103 conventional), it will be in the new Constitution.

The rest of the approved articles were generally rejected. For example, they rejected the first paragraph of article 1. This indicates that “the State recognizes the existence of the climatic and ecological crisis as a consequence of human activity. It is the duty of the State to develop actions and adopt measures at all levels for the management of the risks, vulnerabilities and effects caused by the climate and ecological crisis”.
They also rejected the subsections of article 23, on animal rights. The first paragraph states that “the State will protect animals, recognizing their sentience, individuality and right to live a life free from abuse.”
Another article that did not reach the quorum of 2/3 was article 33, in which “the right of binding and incidental participation in environmental decision-making is recognized. The participation mechanisms will be determined by law”, the text maintains.
The same happened with article 37. It states that “all persons have the right to access public environmental information, which is in the possession or custody of the State, and of the companies, institutions and organizations that provide services to the State.”
