The Comptroller’s Office rejected the bidding rules for the cadastre of indigenous lands that the Government tried to carry out for the second time in the regions of Bío Bío, La Araucanía, Los Ríos and Los Lagos; this, after detecting technical errors in an exhaustive legal analysis of the document, last December.

Said tender is a pending item that has been yearned for by the Piñera administration since its first term, which wants the Government to make a cadastre of the indigenous lands, analyzing the grant titles that have already been returned to the communities, in order to know How many are left to return?

“Carry out a global registry of the situation of the land, containing those already delivered, their state of production and the pending commitments of the State,” warned the President in his last public account, noting that it is a situation that must be resolved.

According to Radio Bío Bío, the Comptroller body noticed inconsistencies in form and substance, along with a series of technical errors in the document, in which it is seen that the bidding stages and several of the evaluation criteria were not specified in the bidding conditions. they do not follow what is stipulated by the Ministry of Finance in current regulations.

Among other inconsistencies in the document, it is detailed that an evaluation will be carried out on the contracted service provider, at least every 12 months, the contract will have an initial duration of only 6 months.

The text also establishes that the economic offer must not exceed the amount available for the tender, which is contradictory with what is stipulated in the bases, an amount that experts consider that the cadastre will be tendered for an amount between $ 5 thousand and $6 billion and is ideally intended to be awarded by regional universities. In addition, the bases refer to a market study that is not attached.

The main point that is questioned is whether this study is pertinent or not, since one of the legal missions of Conadi (National Corporation for Indigenous Development) is precisely to be in charge of registering indigenous lands and having said faculty, a tender of this type may not be necessary, especially considering the care of public resources that the entity must govern the public administration.

It should be remembered that this is the second official attempt made by the Government to finalize the cadastre, since in 2018 Minister Alfredo Moreno led the idea that was rejected by the Comptroller, since it was Conadi that should keep said registry.

However, the corporation, likewise, is part of the organizations that will exhaustively evaluate the bases of the tender, a fact for which the Mapuche communities show concern that Conadi will carry out the cadastre based only on the title deeds, as stated Third.

The titles have a date of delivery between 1884 and 1929 to the Mapuche communities that were relocated in the process of occupation of La Araucanía. It is an acknowledgment by the State that these lands belonged to them. However, the peoples are categorical in affirming that the territorial universe contemplated by the almost three thousand grant titles is not enough, since their demand for ancestral lands is much greater.

According to Thirdin private it is said that if the matter is resolved, which is the intention of the Executive, the matter will escalate to the point of “becoming a potential source of conflict with the indigenous communities, which could confront the original peoples with the elected president, Gabriel Boric”

The Government, for its part, assures that it is a presidential commitment and that it is only a “study” that will say how much the land debt is and that with this input the next president will be able to decide how to move forward, in order to give an element “vital” that will serve to address the issue in the coming years.

Continuing with his entourage, in the last public account, President Sebastián Piñera promised to prepare the cadastre, which was reaffirmed in Temuco, by the Minister of Social Development, Karla Rubilar.
