After seven months of keeping it in a file, the Constitution Commission of Congress decided yesterday to send to the archives bill number 1704, related to the balance of powers, which was presented by the Executive Branch and which gave rise to the premier’s request Hannibal Torres for the start of the process for a matter of trust.
The president of the Constitution group, Hernando Guerra (Popular Force)convened an extraordinary session for yesterday, in order to speed up the vote on a proposal to archive the Executive’s project.
The underlying objective was leave the president’s government without a floor peter castleregarding the trust issue process for a project that is now archived.
There were 16 legislators of the Constitution Commission who voted in favor of the file decree. Since People’s Force they did it the same Hernando Guerra, together with Alejandro Aguinaga, Patricia Juárez, Martha Moyano and César Revilla.
Likewise, Luis Aragón, Ilich López and Wilson Soto, of Acción Popular); Lady Camones and Eduardo Salhuana, from APP; Alejandro Cavero and Adriana Tudela, from Avanza País; Gladys Echaíz and Alejandro Muñante, from Renovación Popular, as well as José Elías (Podemos Perú) and José Jeri (Somos Perú).
From the bloc of left-wing caucuses there were only nine votes against the file, from the caucuses of Peru Libre, Bloc Magisterial, Cambio Democrático, Perú Bicentenario, Perú Democrático, in addition to Integrity and Development.

The Constitution group did not even allow itself to cite the Premier Hannibal Torres for the support of project 1704, as normally occurs with all legislative initiatives.
Moreover, Hernando Guerra himself recounted his management, reporting the development of more extraordinary sessions to support projects. But at no time did they invite the Executive.
The fujimorista slipped yesterday that his office did not take greater importance to the project of the Executive, because the Constitutional Court (TC) had already confirmed the constitutional nature of Law 31355.
Legislators Ruth Luque (Democratic Change) and Flor Pablo (Integrity and Development) questioned that the commission had not, at least, listened to the premier to support the proposal, with which there was no dialogue.
Law without legitimacy
On October 21, 2021, Congress published, by insistence, Law 31355. This rule establishes parameters so that the Executive cannot raise a question of trust due to constitutional reforms or aspects that are exclusive to the Congresshow to give laws.
Although there were voices from specialists who suggested that this should be regulated through a constitutional reform, Congress chose to do it only with a “development law”, which is another form of authentic interpretation of the scope and limits of the question of trust.
Legislator Jaime Quito insisted yesterday that instead of Law 31355, Congress should go for a constitutional reform.
Thus, the Congress is closing the path of the trust issue and the Palace has announced a response. Legislator Alex Flores, from Peru Libre, stressed yesterday, referring to Law 31355, that “Not everything legal is legitimate”.

Pedro Castillo announces that he will respond
After project 1704 was sent to the archive, President Pedro Castillo announced that he will give an answer to Parliament.
“By mandate of this town, we are going to give you an answer”said the president, without giving further details. Palace sources reported that the issue is being analyzed by Prime Minister Aníbal Torres.
Meanwhile, the president of Congress, Joseph Williamsyesterday sent a letter to the premier, informing him that he will be able to attend the next plenary session, but reminding him that the question of trust can only be raised taking into account the scope (and limits) of Law 31355.
