In the order to open the investigation, with a presentation by María Consuelo Cruz Mesa, delegate attorney of the Disciplinary Investigation Chamber, it is indicated that it will be verified if the commander of the Army violated article 70 of Law 1862 of 2017which establishes that it is a military duty to comply with the Constitution.
The foregoing, in accordance with article 219 of the Constitution, which establishes that “the Public Force is not deliberate; may not meet except by order of legitimate authority, nor direct petitions, except on matters related to the service and morality of the respective body and in accordance with the law“.
In this case, Zapateiro has been criticized for six tweets in which he responds to candidate Gustavo Petro. The leader of the Historical Pact affirmed that there were generals “on the payroll” of the ‘Golgo clan’.
Faced with these statements, the Army commander replied: “I have never seen any general on television receiving ill-gotten money. Colombians have seen you receive money in a garbage bag“.
For this reason, the Public Ministry, after citing Zapateiro’s 6 trills, said that it is necessary to carry out an investigation to verify the occurrence of the conduct, determine if it is constituting a disciplinary offenseand establish if the presumed responsible acted within any cause of exclusion of responsibility.
