The Court of Children and Adolescents imposed coercive measures on the 17-year-old boy, son of a judge, accused of running over a family in an incident in Juan Bosch City that left Altagracia Ortiz dead and her sister Maribel Trinidad Ortiz and his 14-year-old daughter seriously injured. The measures include conditional release, prevention of leaving the country and prohibition of approaching others.
Altagracia Ortiz’s brother expressed his disagreement with the judicial decision: “I would have liked a measure that had a prisoner, that was the measure I wanted,” he said.
The lawyers of the affected family, led by Hanfiel Polanco, indicated that the investigation is in a “secret” phase. Both they and the Public Ministry will have six months to collect evidence that will allow them to establish “one or other indications,” explained Polanco, who also reported that they have already filed a complaint and could reformulate it according to the findings that arise in the process.
Regarding the health of the victims, the family detailed that Maribel Trinidad Ortiz remains in a “very delicate” condition, while the 14-year-old minor has shown slight improvement.
Previously, the family’s legal representatives denounced a possible cover-up surrounding what happened. According to their version, the driver of the vehicle was not the teenager, but an adult. They allege that it is intended to apply article 303, paragraph 5, of Law 63-17, which establishes a penalty of 1 to 3 years in the case of death due to a traffic accident.
The family maintains that it has preliminary evidence and other indications to classify the event as a murder, indicating that the audiovisual material would demonstrate that the death of Altagracia Ortiz was “a premeditated murder, with a plot.”
