The president in the exercise of the municipal council of Santa Cruz de la Sierra, José Alberti, confirmed that both the institution he directs, the municipal executive and the Public Ministry themselves are waiting for the departmental event to pass to resume negotiations on the land close to El Cristo, whose proprietary right is from the Prosecutor’s Office.

“After September 24, we are going to resume the dialogue and we have seen predisposition from the Prosecutor’s Office. There is also a predisposition of the municipal executive, through the Secretary of Planning, to seek a better solution,” Alberti said, to El Duty, this Monday.

On the field in dispute

The State Attorney General, Róger Mariaca Montenegro, reported last Friday that the Second Constitutional Chamber of the Departmental Court of Justice of Santa Cruz granted guardianship to the Public Ministry to make the construction of the new building of the Departmental Prosecutor’s Office, with an investment of more than Bs 30 million.

The decision was adopted unanimously and chaired by Judge Aldo Quezada Cerruti, who based the ruling within the framework of the Constitution and good procedural faith. “Under the principle of good faith and healthy criticism that this court sends, it is arranged to grant the protection of constitutional protection filed by the State Attorney General and the Departmental Prosecutor’s Office of Santa Cruz,” Quezada said when reading the resolution.

The magistrate remarked that the decision is issued against the municipal authorities operated – executive, legislative and planning secretariat – and notified all the procedural subjects present. In addition, he ordered the background to the Plurinational Constitutional Court.

There is an offer

Alberti said that “we never do not know the owner right; however, they cannot build as they want, which makes the change in land use impossible. In that sense, that land can be done a small chalet, but we can give up or exchange a larger, better located land,” he proposed.

As Alberti commented, similar situation passed the same Public Ministry in San Ignacio de Velasco, where another space was also provided to build a building with the characteristics they wish.

“They already had the experience in San Ignacio de Velasco, (we pointed) to make a exchange, for a 20 -story building for the Prosecutor’s Office. We want a large building, with the ability to serve the entire population, I think that was the message and the authorities understood it,” said the councilor.
