The São Paulo State Court of Auditors (TCESP) ordered the immediate suspension of selection processes opened by the State Department of Education (Seduc) to hire monitors of the Civic-Military School Program.
Wednesday’s decision (3) was unanimous and the result of a representation of a collective formed by deputies and councilors who point out possible improprieties in Notice No. 2/2025, launched by the Secretariat.
According to the decision’s rapporteur, Renato Martins Costa, the suspension was determined due to concern that the contracted hires could be permanentcontrary to the principle of temporary required by the Federal Constitution. In addition, the ECA pointed to the need to prove the compatibility of expenses with the Fiscal Responsibility Law (LRF).
“Among the main points questioned are the absence of budget forecast, temporary hiring without justification of exceptionality, the non -realization of a public tender and the creation of commissioned positions,” says the TCESP in a statement.
According to TCESP information, The Department of Education should immediately interrupt all ongoing selection processes, and do not publish new edicts, make calls or start program activities until new deliberation of the Court.

The decision does not extinguish the Civic-Military School Program in São Paulo, but temporarily paralyzes its implementation in the state until the questions are elucidated with the Court.
According to the rapporteur, it is not for the Court to judge the constitutionality of the law that established the program, a matter under consideration in the Supreme Court (STF). The performance of the ECA is restricted to the control of administrative, budgetary and financial legality of the acts of the Executive Power.
The Court of Auditors also determined that the Secretariat of Education forward detailed information about the published edicts, the phase in which they are and the expenditure amounts already provided or made. Legal guardians will have ten business days to present justifications.
Sought, the state government said it has not yet been notified of the decision.
