The decision was approved by a majority of Plenary of the TCwith the votes against by judges Gutiérrez Ticse and Monteagudo Valdez, who warned that the court should not interfere in judicial processes still in progress. The measure will apply until the TC issues its final ruling, which keeps Unidad Popular’s electoral participation in suspense.
Constitutional Court alleges that the Judiciary altered the electoral schedule
In its resolution, the Constitutional Court argues that the decisions of the Judiciary “exceeded its powers” by ordering the registration of Unidad Popular after the closing of the electoral registry. According to the TC, the schedule approved by the JNE — which set April 12, 2025 as the deadline for party registration — is “intangible” and cannot be modified by any judicial body.
The ruling recalls that, in accordance with the binding precedent of the Lizana Puelles case, no protection process can suspend or alter the electoral calendar. “Any violation of fundamental rights will become irreparable every time a stage of the electoral process is precluded,” says the TC. Under this criterion, the court concludes that the JNE acted within its constitutional jurisdiction.
The referee also warns that the questioned judicial resolutions “could compromise the legitimacy of the 2026 general elections” and generate “irreversible damage” to the principle of legal security. For this reason, it orders the suspension of any judicial decision that allows the registration of Unidad Popular or any other group outside the established deadlines.
