He Constitutional Court received the request for protection presented by the president Dina BoluarteThis appeal seeks to annul the constitutional complaint against him, filed by the Attorney General’s Office, for the death of five people and the serious injuries of another person during the protests following the coup d’état perpetrated by former President Pedro Castillo.
In his lawsuit, Boluarte demands that the actions carried out by the Public Prosecutor’s Office in the case of the 2022-2023 social protests be declared null and void, considering that his constitutional rights to the proper motivation of fiscal resolutions, due process, and the denaturalization of the prerogative of presidential immunity were violated.
The appeal was received by the highest interpreter of the Constitution on August 28, after it was rejected by the Second Constitutional Chamber in the first and second instance.
The Constitutional Court will have to decide whether to admit the claim and call a hearing to evaluate the testimonies of the parties, in order to issue a ruling later.
As a reminder, in November 2023, the Attorney General’s Office filed a constitutional complaint against President Dina Boluarte before Congress. On July 18, the Subcommittee on Constitutional Accusations decided not to approve the report that recommended admitting the constitutional complaint for processing. In light of this, the Permanent Commission must review the complaint.
