He Constitutional Court has ordered the Presidency to respond to the recommendations provided by the Ombudsman’s Office that guarantees the work of the press in the country, which they issued on December 5 and which, so far, have not been responded to.
Through its ruling issued in the Competition Process initiated by the Ombudsman against the Executive Branch, published in El Peruano on December 5, the TC has given the order to respond to the following recommendations made by the entity.
• SUBSCRIBE to the Chapultepec Declaration, which establishes various principles in order to inform the work of States in order to guarantee and protect freedoms of expression and the press.
• PROVIDE for training of the personnel in charge of the security of the president of the republic on the work of journalists.
• DO NOT OBSTRUCT the participation of the media in official acts or other public events of which the president of the republic, or senior officials of the Executive Branch, is a part.
• GRANT interviews to the media in order to guarantee citizens’ right to information.
The Ombudsman’s Office conveyed these results to the Presidency of the Republic through Official Letter No. 044-2021-DP/AAC, dated December 15, 2021, and reiterated its recommendations through Official Letter No. 0006-2022-DP/ACC, dated December 15, 2021. January 27, 2022.
None of these communications were responded to, which motivated the jurisdictional claim of said entity for undermining its constitutional powers to defend fundamental rights, said the Institute of Press and Society (IPYS).
The Constitutional Court ruled that although the recommendations of the Ombudsman’s Office are not binding and the Presidency of the Republic is not obliged to accept them, all State entities have the constitutional obligation to respond if they accept them or not and for what reasons.
