The Criminal Court No. 4 of La Matanza sentenced this Friday Nahuel Agustín Olivera to 14 years in prison and Alexis Leonel Escribanti to 10 years in prison for the “simple homicide with intent” of Tahiel Contrerasthe six-year-old boy who died after being run over on September 13, 2020 in that Buenos Aires district as a result of an illegal bite, according to the verdict released this Friday.

“The existence of the facts has been proven, the participation of the defendants in them has been proven (…) considering the result that the treatment of the matter produces, the court unanimously resolves to issue a guilty verdict in relation to Nahuel Agustín Olivera and Alexis Leonel Escribanti (…) in relation to the events for which Tahiel Luciano Contreras lost his life and the physical integrity of Luciano Guillermo Contreras and Noelia Abigaíl Díaz -parents of the child-“, explained a representative of the court made up of judges Nicolás Grappasonno, Gerardo Clemente Gayol and Franco Fiumara during the reading of the verdict that was carried out by videoconference.

“Impose Nahuel Agustín Olivera to a sentence of 14 years in prison and special disqualification from driving any type of vehicle for six years (…) for being a criminally responsible co-perpetrator of an illegal speed test in a real contest with simple homicide in an ideal contest with injuries repeated minor ones”, he completed.

In the case of Escribanti, the court imposed a sentence of 10 years in prison and special disqualification from driving any type of vehicle for six years, for being a criminally responsible co-author of the same crimes.

During the afternoon of this Friday, the court will communicate the complete sentence and the grounds.

Olivera, a 24-year-old baker, a native of Gregorio de Laferrere, and a 26-year-old radiologist technical clerk, a native of Villa Luzuriaga, had known each other since school, frequented the “picódromo”, and as a result of the fact, they arrived at this judicial instance with effective imprisonment. .

The crime happened during the coronavirus pandemic, the September 13, 2020 after 4:00 p.m. at the intersection of Provincial Route No. 21 and the Soldado Sosa artery in the town of Laferrere, a “densely populated” area.

According to the investigation by the prosecution, Escribanti was aboard a Volkswagen Vento model and Olivera aboard a Chevrolet Corsa model, when they “decided” to carry out an illegal dive, driving along the road at a “superlative” speed, avoiding other cars. and “creating a situation of danger to the life or physical integrity of the people who were traveling on the public highway.”

When losing control of the vehicles, the Corsa collided with a third vehicle that was circulating in the slow lane (the Fox car) and was displaced towards the sidewalk, where Luciano Guillermo Contreras, Noelia Abigail Díaz and Tahiel were hit. , who were waiting to cross to go have an ice cream and then “surprise him by going to the square -in the context of isolation due to the pandemic-“, the mother of the deceased child explained to Télam.

The National Road Safety Agency (ANSV) collaborated with the Justice during the process under the figure of “amicus curiae” (friends of the court) and assisted the family from the beginning.

In October 2020, they presented in the National Congress the Tahiel-Kevin bill (in homage to the son of Viviam Perrone), who is waiting for his parliamentary progress and seeks to create the figure of “road homicide” equating it to that of simple homicide, which provides for a penalty of 8 to 25 years in prison for anyone who causes a death running illegal chopped, they specified, among other key points.

The project was resubmitted in May 2022 so that it does not lose parliamentary status.
