On October 29, Judge Checkley ordered the release of Peralta Santur via ex officio review of the 18 months of preventive detention imposed against him. The measure prohibited the suspended prosecutor from communicating with other investigators, as well as with people who have testified or have to testify as witnesses in the case. In addition, a bond of S/10,000 was set.
Following this decision, Peralta left the Chorrillos prison where she had been held since December 3, 2024 and would continue the process under an appearance with restrictions, however, the supreme prosecutor Zoraida Ávalos requested to declare said release null and void. According to the Penal Code, this request must be resolved before the release is effective, so Judge Checkey modified his resolution and ordered that the release be carried out only when the measure is consented to and is final.
In the location and capture resolution issued by the magistrate, it was established that the measure be communicated to the National Police, the Registry of Requisitions of the Judiciary, INTERPOL and the National Superintendence of Immigration, providing Peralta’s identity and address information, in order to facilitate his prompt location and ensure the development of the process against him.
