Supreme Court rejects the release of Mario Aburto, confessed murderer of Colosio

Ministers Loretta Ortíz Ahlf, Lenia Batres Guadarrama and the rapporteur minister Juan Luis González Alcántara Carrancá voted to revoke an amparo that granted freedom to Aburto.

In his project, Carrancá pointed out that the victims or offended parties always have the legitimacy to be part of the amparo trial, since in criminal cases their interest is not limited to obtaining compensation for damage, they also have the right to know the truth and justice.

The guarantee trial will return to the First Collegiate Criminal Court of Toluca, which will be in charge of notifying Colosio’s relatives so that they can join the process.

In 2023, Luis Donaldo Colosio Riojas, son of Colosio Murrieta, said that his family had no interest in the case remaining open. At the time, he asked then-president Andrés Manuel López Obrador to pardon his father’s murderer.

Mario Aburto shot the man from Sonora twice during a rally in Lomas Taurinas, in the border city of Tijuana, in Baja California. In December 1995, he was sentenced to 45 years in prison.

Currently, the Michoacan is still serving his sentence in a federal prison.

In March 2019, the National Human Rights Commission (CNDH) reported that it would begin an investigation into alleged acts of torture and obstruction of Aburto’s access to health.

Two years later, in 2021, the Commission directed a recommendation to the Attorney General’s Office (FGR) and the Decentralized Administrative Body for Prevention and Social Readaptation, for serious violations of human rights, personal integrity and dignified treatment towards Aburto. .

In that same year, then-president Andrés Manuel López Obrador offered protection to Mario Aburto if he was willing to tell his version of the assassination of presidential candidate Luis Donaldo Colosio, committed in March 1994.

López Obrador assured that his government was interested in ensuring that there was no doubt about the murder of Colosio, who was the PRI’s presidential candidate in 1994 and after his death was replaced by Ernesto Zedillo, who ultimately won the elections.
