The Plenary Chamber of the Supreme Court of Justice of the Republicthe highest deliberative body of the Judiciary, issued a statement to set a limit on the statements of the president of Congress, Fernando Rospigliosi, who not only openly questioned magistrates for not aligning with laws promoted by Parliament, but also came to apraise the need to “sweep away” the judicial system.
“The Supreme Court of Justice rejects the conditioning of judicial decisions or the imposition of any type of censorship. It is also unacceptable for the Judiciary that resolutions issued within the framework of its legitimate powers are the occasion for threats of interventionism, the application of disciplinary measures or any other type,” they point out.

“Doing so implies destroying the justice system, whose apex is the Judiciary, as well as annulling the effective jurisdictional protection to which each and every citizen is entitled. When justice is interfered with or controlled, the only person harmed is the people, especially those who are most vulnerable,” the statement reads.
The statement comes after Rospigliosi will publicly question judges who refused to apply the law approved by Congress which opens the door to the prescription of crimes against humanity committed before 2002, within the framework of the case Cayaraas well as after his complaint to the National Board of Justice (JNJ) against a judge who declared articles of the so-called inapplicable law against NGOs (APCI Law).
Likewise, the Fujimori congressman accused the judges who did not apply the law on the statute of limitations for crimes against humanity as “prevaricators” and questioned whether the Judiciary does not comply with norms approved by Congress, despite the fact that the judges based their decision on constitutional standards and international law.
In this context, the Plenary Chamber expresses its rejection of any attempt to instrumentalize political power to influence justice and expresses its concern about the impact this has on the democratic order.
“The Judiciary rejects those prohibited practices, especially when it is intended to demand or use political power to carry out these behaviors contrary to the democratic order,” they add.
Despite this, far from moderating his speech after the institutional position of the Supreme Court, Fernando Rospigliosi He attacked again from his social networks and redoubled his attacks against the magistrates.
“It is necessary to sweep away the judicial system, which persecutes soldiers and police who defeated terrorism and fights against crime, and at the same time protects criminals. Only yesterday, a court convicted a colonel EP (r) for an event from 1994 and in another trial keeps soldiers in prison unjustly accused of an event from 1988. In both cases they refuse to apply the current law 32107, trampling with impunity on the Court’s decision Constitutional. With these magistrates we will not be able to defeat crime. We must sweep away the judicial system! Radical solutions!
Rospigliosi denounces a judge before the JNJ for a ruling that stopped a Congressional law against NGOs
It is worth remembering that the head of Parliament filed a complaint with the JNJ against the judge who ruled in favor of the Legal Defense Institute (IDL), and accused her of disobeying a law approved by the Congress.
“Rocío del Pilar Ramírez, a prevaricating judge who has disregarded the Congressional law on APCI and NGOs (…) does not want to apply a law that is promulgated by the Government,” he said from Pasos Perdidos.
The parliamentarian’s initiative came after a ruling by the Sixth Constitutional Court, which heard a request for protection filed by the Legal Defense Institute (IDL). In that decision, the judge annulled, for this specific case, some articles of the so-called anti-NGO law, concluding that these contravened fundamental rights such as freedom of association, the right to defense and access to justice.
