Supreme Court issues first appeal to “demand the resignation” of Yasmín Esquivel

The Supreme Court of Justice of the Nation (SCJN) rejected the petition of the civil association México Justo, founded by the former president of the highest court Genaro David Góngora Pimentel, in which the resignation of the minister Yasmín Esquivel Mossa, accused of Plagiarize your bachelor’s thesis. This is the first appeal on this case that is rejected by the Court.

The organization delivered to the Court, on January 13, a letter in which it asked all the ministers demand the immediate resignation of Minister Yasmín Esquivel Mossa from her positionbased on article 95 of the Constitution, where it is established that to be a member of the plenary session it is necessary to have honor, competence and background in the exercise of legal activity.

The document, signed by the president of México Justo, Juan Carlos Pérez Góngora, Góngora Pimentel’s nephew, was registered in the highest court as file 2290/2022-VIAJ and submitted to the consideration of the president minister Norma Lucía Piña Hernández.

The association argued that The presence of Yasmín Esquivel Mossa demerits the work and the figure of this high court, therefore, as representatives of the academy, we categorically disqualify the cited acts and demand her resignation for the good of Mexico.

In the courts of the highest court, the dismissal agreement was published, in which it is reported that, based on article 14, section II, first paragraph, of the Organic Law of the Judiciary of the Federation, it is agreed: There is no reason to consider the document indicated in numeral 1 of the account of this determination submitted..

The aforementioned law grants the presiding minister the power to admit or not to process the matters that are presented before the SCJN, with the exception of those that considered doubtfulas was considered in this matter, in which the complainant association did not raise any legal representativeness or judicial litigation and only limited itself to making a call to the ministers.

This is the first petition that the SCJN rejects on the case of Minister Esquivel and there are still some 20 complaints for the possible commission of administrative offenses.

These complaints allude to the accusations of the UNAM on the plagiarism of the thesis and request to proceed against Esquivel on the grounds that does not preserve the dignity or professionalism of the judicial function.
