The Supreme Court rejected the appeals for annulment presented by the defense of Ramon Vargas and of ruben gallegoswho were sentenced for throwing Molotov cocktails in an activity in which the mayor of Recoleta participated, Daniel Jaduein Osorno during February 2020.
On July 28, 2021, the Osorno Oral Criminal Trial Court sentenced Ramón Vargas to four and six years in prison, for his capacity as the author of the crimes of throwing an incendiary device and frustrated arson. Meanwhile, Rubén Gallegos received the effective sentence of three years and one day and five years and one day, for being a co-perpetrator of the same crimes.
The Second Chamber of the highest court in a divided ruling ruled out infringement of due process in the assessment of the evidence carried out by the Oral Criminal Trial Court of Osorno.
“(…) it is not possible to find in the grounds provided any that could be deemed to contravene the legal parameters as criticized in the appeal, even more so bearing in mind that the annulment of the trial and the sentence is not justified by a simple or mere disagreement with the Court of Oral Criminal Trial, as occurs in this case (…)”, indicates the resolution of the highest court.

It was on February 27, 2020 when the convicts went to the headquarters of the Luterna evangelical temple, located in the Francke sector of Osorno, where the former presidential candidate, Daniel Jadue, was carrying out an activity with the Social Council of the city.
In that place, Vargas entered one of the bathrooms and lit a Molotov cocktail to later throw it against the window. Due to the actions of third parties, a fire was prevented. Finally, he fled in his companion’s vehicle, but they were chased by witnesses to the action.
