Supreme Court condemns Miguel Krasnov for the murder of Miguel Enríquez

The Supreme Court rejected the cassation appeals filed against the ruling that convicted three agents of what was then called the National Intelligence Directorate (DINA), for their responsibility in the crime of aggravated homicide against the secretary general of the Movement of the Revolutionary Left ( MIR), Miguel Enríquez, which occurred on October 5, 1974 in the commune of San Miguel.

In a unanimous ruling, the Second Chamber of the highest court ratified the sentence that sentenced Miguel Krasnov Martchenko to 10 years and one day in prison, as the author of the crime. Meanwhile, agents Teresa Osorio and Rodolfo Concha must spend 5 years and one day behind bars for their participation as co-authors.

In the sentence, in the Criminal Chamber made up of the ministers Haroldo Brito, Manuel Antonio Valderrama, Leopoldo Llanos and the lawyers (i) Gonzalo Ruz and Ricardo Abuauad, ruled out a legal error in the accredited participation of Krasnov in the aforementioned events.

“That, based on the foregoing, it is first convenient to specify, although the libel indicates the numerals that it considers have been violated, the reading of the resource does not demonstrate its imputation, since it only cites the provision to raise a discrepancy regarding the assessment that The ruling confers the elements of conviction gathered and related in the sentence according to which the intervention of Krasnov Martchenko in the facts was considered accredited, disagreeing with his conclusions, an issue unrelated to this appeal of a substantive nature, ”says the document.

For his part, the leader’s son, former presidential candidate Marco Enríquez Ominami, stated that “it is important that what we have been affirming for years be ratified. That what was here was a policy of the Chilean State to exterminate what the State Chile had identified as enemies of a political sector”.

“My family, after 47 years of the murder of my father and for many of us who believe that justice must be done, it is a day. I think of my grandmother, who died with a missing son, a missing son-in-law, a son executed, exiled grandchildren and separated. It is news that I would have liked her to have been able to read, “he emphasized.

“This is a day that makes Chile a slightly fairer country,” he concluded.
