The Federal Supreme Court (STF) concluded this Wednesday (25) an agreement that guarantees indigenous people possession of the Indigenous Land (TI) Ñande Ru Marangatu, in Mato Grosso do Sul. Under the agreement, the Union will compensate the owners of the land, who must leave the place within 15 days. After this period, the indigenous population will be able to enter the space peacefully.
The region was the target of violent disputes between indigenous people and farmers, which culminated in in death young Neri Guarani Kaiowáshot in the head on September 18th. The episode provoked revolt among the indigenous peopleentities defending indigenous peoples and the Minister of Indigenous Peoples, Sonia Guajajara.
The agreement was reached in a hearing called by Minister Gilmar Mendes, rapporteur of the case. Representatives of landowners, indigenous leaders, members of the National Foundation of Indigenous Peoples (Funai), the Federal Attorney General’s Office, the Ministry of Indigenous Peoples and the government of the State of Mato Grosso do Sul participated.
Indemnity
The Union must pay the owners the amount of R$27.8 million for improvements identified in an individual assessment carried out by Funai in 2005, adjusted for inflation and the Selic Rate. The amount will be made possible through supplementary credit.
The owners must also receive compensation from the Union in the amount of R$101 million for the bare land. The State of Mato Grosso do Sul must also make, in judicial deposit, the amount of R$ 16 million, also to be paid to the owners.
The agreement also provides for the extinction of all processes pending in the Judiciary involving the IT dispute. The proceedings will be terminated without a resolution on the merits.
Celebration
At the request of the indigenous people, a religious and cultural ceremony was discussed and included in the agreement by consensus with the owners at the place where Neri Guarani Kaiowá died. The event will be attended by 300 people from the indigenous community next Saturday, September 28, from 6 am to 5 pm. Funai and the National Force will accompany the event.
