The President of the Federal Supreme Court (STF), Minister Luís Roberto Barroso, decided this Thursday (24) to transfer to the Court the conciliation process regarding the compensation for damages caused by the collapse of the Fundão dam, in Mariana (MG), occurred in 2015.
With the decision, the agreement that will be signed this Friday (25) between the federal government and the mining companies, at Palácio do Planalto, must be approved by the Court, no longer by the Federal Court in Minas Gerais. President Luiz Inácio Lula da Silva will participate in the event.
In Barroso’s understanding, approval will allow the agreement to have legal certainty.
“The conclusion of the agreement with approval by the STF will be able to avoid the continued judicialization of various aspects of the conflict and the prolongation of the situation of legal uncertainty, nine years after the disaster”, argued the minister.
United Kingdom
In London, another compensation action began to be judged this week. The action involves around 620,000 victims and seeks to order the mining company BHP Billiton, a shareholder in the mining company Samarco, which operated in Mariana, to pay compensation. The company is based in London.
The collapse of the Fundão dam caused 19 deaths and caused damage to the populations of dozens of Minas Gerais and Espírito Santo communities along the Rio Doce basin.
