The judges did not specify a deadline and asked the Columbia district court to clarify how the Executive must “make” this transfer, so that the court order does not clash with the privilege of the Executive “to handle the country’s foreign policy.”
The case of Abrego García, 24, has indicated it politicians and organizations to criticize Trump’s mass deportation campaign.
The Salvadoran had legal status in the US and is married to an American citizen. He lived in the state of Maryland and fled from El Salvador for the extortion and threats that he and his family received from the Barrio 18 gang, according to judicial documents presented by his defense.
The decision of the Supreme, written by three of the liberal judges of the Court, strongly criticizes the government’s judicial arguments to justify their deportation and detention.
The American immigration authorities described the shipment of Abrego as an “administrative error”, but claim that they have no power to return it to the country, because it is now in custody of a foreign government.
The Trump administration also argues that Abrego García, who has no judicial record in the US that links him to organized crime, is a member of the MS-13 gang and that he should not return to the country.
As part of Trump’s agreement with President Nayib Bukele, Washington will pay El Salvador 6 million dollars annually to sustain the prison system. The Trump government has sent a total of 232 migrants to CECOT, mostly Venezuelans, accusing them of belonging to the Criminal Band of Aragua.
