The Superintendency of Transportation opened two investigations by filing charges against the freight transport companies Coltanques SAS and Tractocar, for allegedly ignoring the rights derived from economic relations in the sector, apparently, they would not be recognizing in their payments the additional time involved in loading and unloading of merchandise in some operations, in addition, they would be making discounts without the corresponding authorizations.
According to him Transportation Superintendent, Wilmer Arley Salazar Arias, “the basis of a legal and efficient logistics chain, among other things, is given by the permanent recognition of those rights derived from economic relations. Seen in this way, compliance with the regulations that regulate the negotiations is constituted as a basic principle in freight transport to achieve a balanced, equitable, efficient sector with welfare opportunities for all, including cargo generators, transport entrepreneurs, owners, drivers and operators, among others, who make a living for themselves and their families within this economic model that connects the country.”

As a result of the complaints filed with the Superintendency of Transportation, together with the transportation infractions that originate the imposition of Single Reports of Transportation Infractions (Iuit), the entity found merits to file charges for allegedly failing to comply with the obligation to cancel in a timely manner the value to be paid, and the amount generated by those additional waiting hours, to the owners, possessors or holders of the vehicles. In addition, for making unauthorized discounts to the value to be paid agreed with the owners, holders or holders of the public cargo transport vehicles and for allegedly allowing the vehicles to provide the public cargo transport service exceeding the authorized weight limits.

The entity also advances 10 preliminary investigations against different cargo transport companies for allegedly failing to comply with its obligations regarding the value to be paid, since the owner, possessor or holder of a public cargo transport vehicle and the additional waiting hours would not be recognized.
Likewise, 13 preliminary inquiries are under way against other freight transport companies for allegedly failing to comply with their obligations, regarding the value to be paid, by making unauthorized discounts.
In case of being found responsible, the investigated companies in question could be fined up to 700 legal monthly minimum wages in force.
