The official recalled that “The unattainability of the resources destined for health is based on the provisions of article 25 of Statutory Law 1751 of 2015, article 182 of Law 100 of 1993, article 2.6.4.1.4 of Decree 780 of 2016, and the current constitutional jurisprudence, including Judgment T-760 of 2008 and recent pronouncements”
As explained, these norms establish a clear legal framework that prevents money that finances assurance and health care are subject to embargo or of measures that put the continuity of the services at risk.
Rubiano emphasized that the principle of unattachability aims to ensure that the flow of resources towards providers is maintained in a timely manner, protecting the sustainability of the system and ensuring that the general interest prevails over particular interests. “Judicial measures cannot paralyze the operation of the system or prevent effective access to health services”He said.
