The National Superintendence of Sanitation Services (sunass) removed from their positions five directors of utility companies in the last 2 years upon detecting non-compliance with requirements or causes of impediment to exercise the position.
The directors who were removed from their positions belonged to EPS Tacna SA, EPS Rioja SA, EPS Sedachimbote SA, Emapa Huancavelica and EPS Sedacusco SA Four of them did not meet all the requirements for the position and one of them was included in a cause of impediment to hold office.
In order for a director to be removed from his position by Sunass, it must be verified that he does not meet one or more requirements to be a director, such as having the professional university degree required by law, having postgraduate studies or specific specialization, proving experience Professional of five years in managerial or managerial positions and not be involved in any cause of impediment.
Likewise, it can be removed for applying tariff formulas different from those approved by Sunass, not informing the Comptroller General of the Republic and the sectoral authorities of any fact contrary to the legal norms of which it has become aware through any regular channel, in the exercise of office, among others.
Among the causes of impediment to exercise the position of director are being mayor, alderman or having a family relationship with said authorities, having been dismissed for administrative or disciplinary offenses in companies, having developed commercial activities directly or indirectly related to the provision of sanitation.
Meanwhile, an EPS general manager can be removed for not meeting the requirements such as having a professional university degree required by law, having postgraduate studies or specific specialization, accrediting three years of professional experience at a managerial or managerial level, and not be involved in any cause of impediment.
The impediment requirements are evaluated during the process of election and appointment of EPS directors, as well as during the performance of the position.
To prevent these people from applying for a similar position in the future, the sanction is registered in the EPS registry file, which appears in the National Superintendency of Public Registries (Sunarp). Said document remains available for public consultation so that the sanctioned person cannot be elected by the General Shareholders’ Meeting of the EPS or appointed by the Deputy Minister of Construction and Sanitation of the Ministry of Housing, Construction and Sanitation (MVCS).
